Yes! This notion that everything about human rights is up to the will of the voters is dangerous and frightening. The founders themselves warned us about the tyranny of the majority and explicitly endorsed the notion of unenumerated rights to protect citizens from the voters. The only way conservative judges can get their way on social issues is to destroy or greatly attenuate the notion of sacrosect on enumerated rights. And here they go!
