We have much the same problem with queer refugee policy here in the United States. The long and short of it is, "Prove you're gay by acting gay like US gay peope act gay. And then convince us you aren't capable of acting otherwise. Then we might or might not grant you asylum."

Mostly we don't grant asylum, because we have strict quotas on that sort of thing, put in place because of a non-existent immigration "crisis" politicians invent and run on to get elected.
