The high court’s recent tendency to reinforce moves that consolidate rule by minority is difficult to understand outside a lens of pure partisan politics.

After reading David Litt’s article in Gen this morning, in which he warns that much of the Court’s power stems from an implicit bargain with the American people to avoid partisan politics, I wonder if the justices are aware of the harm they are doing to their institution.

That’s without even asking if they are aware of the harm they are doing to American democracy.
