"Sodomy was considered a felony until 1962,"
Sodomy laws remained on the books in many states long after 1962. Not until 2003 did the US Supreme Court rule that sodomy laws violate the US constitution, and they did that in response to Texas enforcing its sodomy law.
When the Supreme Court struck down Roe v Wade earlier this year, two of the justices wrote that the decision overturning Texas's sodomy law should also be reconsidered.
The attorney general of the State of Texas went on the record soon after to say that he believes the Texas sodomy law should be enforceable.
