It's hard to imagine how allowing state agents to refuse to perform civic functions on religious ground would not amount to the state establishing religion.

Unfortunately, the federal judiciary is highly unlikely to appreciate that argument, given that several Supreme Court justices seem bent on a campaign to elevate religious privilege to levels that would have shocked our founders.
