I wrote an article about a year ago spelling out how some conservative states like Idaho I continuing to force gay men to register as sex offenders because they were convicted of homosexual sex that was illegal before Lawrence v Texas. Those laws can no longer be enforced, but states can and do use them in other ways to intrude into people's private sex lives.
Many states refuse to remove sodomy laws from their books. They can't enforce them right now, but they want to enforce them. And they will, given half a chance.
